(“we”, “us” or “our”). This Privacy Notice applies to the Site and Services (as defined in the Membership and Use Agreement) and describes the information that we collect on the Site and through the use of our Services, how we use it, how we protect it, and the choices you can make about your information. By creating an account on our site or by checking a box to indicate your consent to this Privacy Notice, you expressly consent to the information handling practices described in this Privacy Notice, including the deployment of cookies, pixels, and similar third-party tracking technologies for the purposes described herein. Further, you acknowledge and confirm that you have permission to provide the personal information for the purposes described below. If you do not agree with the terms of this Privacy Notice or the Terms (as defined in the Membership and Use Agreement), you should immediately stop using or visiting the Site. In addition to the rights discussed in this Privacy Notice generally, you may be entitled to additional rights regarding your Personal Information if you are a resident of any of these jurisdictions: European Economic Area Switzerland United Kingdom States that have passed data privacy laws applicable to Skilljar, which currently comprises: California, Colorado, Connecticut, Indiana, Iowa, Maryland, Minnesota, New Jersey, Oregon, Tennessee, Texas, Utah, and Virginia. For information regarding our privacy practices and your privacy rights under the data privacy laws of the corresponding jurisdictions above, please refer to the sections titled “Your Rights and Choices Regarding Your Information Under Data Privacy Laws” below. If you are an employee or job applicant who resides in California, personal information that you submit to Skilljar in connection with current or prospective employment will be processed in accordance with our Privacy Notice for California Personnel. Information We Collect We collect the following types of information in the manner described below. You may voluntarily provide us with information, including: Your name, email address, and any other information that you provide in registering to use the Site and Services; Information when you contact us; and Any other information you voluntarily provide us within using the Site and Services, including comments and other content. We automatically collect other information about you, including: Your Internet Protocol address; Domain name of your Internet service provider; Your approximate geographic location; The Site pages that you visit and the time of your visits; and Aggregated information that cannot be used to specifically identify you when you use or visit the Site and Services. We may combine all of the information we collect from or about you and use it in the manner described in this Privacy Notice. Internal processing purposes “Personal information” does not include: publicly available information from government records; deidentified or aggregated information; and other information excluded from the scope of State Privacy Laws (as defined below). Additionally, Skilljar does not use or disclose any sensitive personal information at this time. You, directly and indirectly, are the source of the categories of personal information listed above. For example, we may obtain information from you directly through the forms you complete using the Site and/or Services. We also automatically collect information as you use our Site which may include IP addresses, and information collected through cookies, pixels, and related tracking technologies. In any cases where the personal information above is provided to us, we will process that information in accordance with applicable laws. How We Use Your Information We may use or disclose the information that we collect for one or more of the following business purposes, which do not require that we share the collected information with any third parties apart from our service providers (“internal processing purposes”): The purposes for which you provided it; To administer and provide you with information about your account; To send you information about your relationship with us; To develop new services; To process and respond to your inquiries and comments; To personalize and enhance your experience using the Site and Services; To generate and review reports and data about our user base and service usage patterns; To compile aggregate data for internal and external business purposes; To administer, operate and improve the Site and Services and for internal business purposes. Further, we may also use or disclose the information that we collect for one or more of the following marketing or advertising purposes: Advertising and marketing our products and services to you, which may include sending promotional e-mails, using contextual advertising, tailoring advertisements displayed to you on our Services and elsewhere based on your interests and history with us, and personalizing the advertisements you see on third-party platforms and websites; Enabling our marketing partners to follow up regarding products or services in which you have expressed interest when you sign up for a program hosted by Skilljar or a Skilljar marketing partner. We will not collect additional categories of personal information or use personal information we collected for materially different, unrelated, or incompatible purposes without providing you notice. Additionally, note that you can unsubscribe from our promotional emails by clicking on the “Unsubscribe” link at the bottom of the e-mail and following the instructions provided. Even if you opt-out of receiving promotional messages from us, however, you will continue to receive administrative messages from us. How Your Information is Disclosed Personal information may be disclosed to third parties for the purposes described in this Privacy Notice. When we disclose personal information to a third party, we enter a contract that describes the purpose and requires the recipient to both keep that personal information confidential and not use it for any other purpose. Please note that a user may choose not to share certain information as described in Your Choices Regarding Your Information Under Data Privacy Laws” below. We may share personal information with the following categories of parties: Third Party Service Providers. We may use third party service providers to perform functions in connection with the Site and Services. Examples include account management ticketing and sending you notifications of key platform improvements via email. We only share information about you that they need to perform their functions and they are not allowed to use your information for any other purposes. For more information about how we use cookies, please see the “Cookies” section below. Note that we use certain third-party generative AI service providers to offer features which enable users to generate and receive output based on user prompts. Those generative AI features only process personal information that is entered as part of a user’s prompt, and is not necessary to use such features. If you elect to input, upload, or otherwise submit user prompts containing personal information to our generative AI features, your personal information will be processed on the terms described in our AI Supplement. Marketing Partners. We may disclose certain personal information with our marketing partners and service providers for purposes of “cross-context behavioral advertising,” or targeted advertising regarding Skilljar's products and services based on personal information that we obtain from your activity across distinctly branded websites or services. Additionally, from time to time, Skilljar may host or co-present webinars and other public presentations with our marketing partners.
